Overview of the Spanish residence system:

  • Initial temporary residence: at this point residence permits are temporary and permit 12-months of residence. Upon their expiry, either 60 days prior to or up to 90 days after their date of expiry, they can be renewed.
  • The first renewal: the permission continues to be temporary, and the holder should make a renewal application which demonstrates that they continue to meet with the specific requirements set out in the residence law and demonstrate that they have spent no less than 183 days in Spain per previous calendar years of residence. (at current demonstrated through passport copies with stamps, this has now changed)
    A successful application will provide the renewal of the permission for a further 24 months.
  • The second renewal: the permission continues to be temporary, and the same renewal procedure should be carried out demonstrating that the holder continues to meet with the specific requirements set out in the application and has spent no less than 183 days in Spain per previous calendar years of residence. 
    A successful application at this point will provide the renewal of the permission for a further 24 months, or should the requirements* be met, a 5-year long-term permanent residence. (at current demonstrated through passport copies with stamps, this has now changed)
  • The third renewal: this will either be an application to obtain the long-term residence after 5-years, or a new temporary residence application back to stage 1. *
  • *Requirements:
    Long-Term residence can be obtained by demonstrating continuous residency of a minimum of 10-months per year in Spain over the period of temporary residence of 5 years.
